In the past, BJP MP Manoj Tiwari had reached the court against the decision of the Delhi government. He filed a petition in the Supreme Court. In the petition, he has said that freedom of religion cannot be taken away on the pretext of right to life.

BJP leader Manoj Tiwari has sought orders for the Delhi government to issue new guidelines regarding the sale, purchase and bursting of firecrackers acceptable. The petition has also sought a direction to all the states not to take any punitive action like registering an FIR against the common people selling or using acceptable firecrackers during the upcoming festival season.

Earlier, during the hearing, the Delhi High Court asked green crackers traders whether it was not appropriate for them to approach the apex court against the ban on sale and use of all types of firecrackers in the city during the coming months. At the same time, the counsel for the Delhi government on this matter said that the order to impose the ban was issued in view of the air quality of the city, which was deteriorating. The petitioners, ‘Shiva Fireworks’ and ‘Jai Mata Stores’, in their plea said that since the air quality in Delhi has been “moderate” since August 15, there is no need to ban even the use of green crackers.
